Preamble
These terms of sale govern the commercial relations between the company Vaporglobal Logistics, Bloc 1 nr 672 Madinat El Wahda Laâyoune, Laâyoune - Morocco, hereinafter referred to as the seller, and any natural or legal person, hereinafter referred to as the buyer, wishing to make a purchase on the website www.levapoteurmarocain.com. The following terms of sale govern all transactions made on Vaporglobal Logistics' web catalog. Any order placed on this site implies the customer's unconditional and irrevocable acceptance of these terms. The seller reserves the right to amend these Terms of Sale at any time. The applicable version is the one in force on the site on the date the order is placed.
Article 1: Purpose
This contract is a distance contract whose purpose is to define the rights and obligations of the parties in the context of the sale of Vaporglobal Logistics' products over the Internet, through the secure online payment platform of the Centre Monétique Interbancaire.
Article 2: The buyer
The buyer must be at least 18 years old and have the legal capacity to place an order on the site. The buyer must ensure that their personal data in the "my account" section is accurate and complete (in particular access code and/or phone number). The seller cannot be held responsible for the inability to deliver the order if the buyer's data contains an error or is incomplete. The seller reserves the right to cancel an order if there is any doubt about the buyer's good faith.
Article 3: Prices
Product prices are shown in Moroccan dirhams, all taxes included, excluding the contribution to processing and shipping fees. Shipping fees are charged in addition, according to the order amount. Shipping fees are shown before the customer confirms the order. All sales are payable in dirhams regardless of where the order is placed. The seller reserves the right to change its prices at any time, but products will be invoiced according to the prices shown at the time of the order.
Article 4: The products
Products offered for sale by the seller are presented and detailed so that any buyer can know the essential characteristics of the products. The buyer therefore reviews the characteristics of the products sold on the site www.levapoteurmarocain.com, intended for vapor production. These characteristics and photos comply with the information provided by the seller's suppliers, the seller not being the manufacturer. The buyer takes responsibility for choosing products based on the characteristics provided on the product presentation page on the website, the recommendations issued, and the certifications. The seller's liability cannot be engaged in the event of incidents and any special damages, health or sanitary issues resulting from the use of the products. The buyer acknowledges using this product under their full and entire responsibility. Likewise, the seller's liability cannot be engaged in the event of excessive consumption or failure to properly use the products in accordance with their intended purpose (or in the event of use with other products), in particular in accordance with the instruction manual and the characteristics provided on the products' presentation pages on the website. It is reminded that the electronic cigarette is prohibited for minors, not recommended for pregnant or breastfeeding women, and for people suffering from cardiovascular disease, epilepsy, asthma or sensitivity to nicotine. It is also reminded that the electronic cigarette is not a smoking cessation method. The products offered comply with current legislation and applicable standards. The seller's liability cannot be engaged in the event of non-compliance with the legislation of the country where the product is delivered (for example in the event of a product ban). It is up to the buyer to check with local authorities the possibilities of importing or using the products or services they intend to order. The seller expressly retains ownership of the goods delivered until full payment of the sale price. This provision does not cancel the liability clause mentioned below from the moment the order is transferred to the buyer, the seller not being responsible for losses or damage from the moment the order has left its premises.
Article 5: The order
When placing their first order, the buyer must create an online account with their personal details. The buyer must keep these up to date. By confirming their order, the buyer accepts the price and characteristics of the products presented on the site www.levapoteurmarocain.com. By confirming their order, the buyer confirms that they have read the Terms of Sale and accept them without reservation or restriction. No special condition may, except with our formal written acceptance, prevail against our terms of sale. After confirming the order, the buyer will receive by email a confirmation summarizing their order. Transaction data recorded by the site www.levapoteurmarocain.com constitutes proof of all commercial transactions made with the buyer. Information recorded at payment constitutes proof of all financial transactions between the site and the buyer.
Article 6: Availability
Product offers are made while stocks last. Product availability is shown on the product presentation page. This indication is provided for information purposes. Should a product become unavailable after your order is placed, the seller will contact the buyer by email, mail, or phone. The buyer will then have the option to cancel or modify their order. In the event of total unavailability, the order will be cancelled and the buyer will be refunded. In the event of partial delivery of your order, the buyer will contact the seller to reach an agreement on a possible exchange, refund, or delivery delay.
Article 7: Payment methods
All orders are expressed in dirhams, all taxes included, with the VAT rates applicable in Laâyoune, Morocco. To confirm their order, the customer can choose among the payment methods offered by Vaporglobal Logistics on the payment page, namely Cash on Delivery or online payment (CMI). With Cash on Delivery, the buyer can pay for their order in cash directly upon receipt of their items. As for online payment via CMI (Carte Monétique Interbancaire), the transaction is debited from the buyer's account on the day following the delivery confirmation date. Your online payments are secured by the Centre Monétique Interbancaire (CMI), which offers a fully secure payment service. The buyer guarantees to Vaporglobal Logistics that they have any authorizations necessary to use the chosen payment method when confirming the Purchase Order. In the event of payment by bank card, the provisions relating to fraudulent use of the payment method provided for in the agreements between the Consumer and the card issuer, and between Vaporglobal Logistics and its bank, shall apply. The seller reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and stage of execution, in the event of non-payment of any sum owed by the buyer, in the event of a payment incident, or in the event of an ongoing dispute with the buyer.
Article 8: Delivery
Products will be delivered to the address provided by the buyer when purchasing on the site, which can only be within the planned geographic area (Morocco). The buyer must ensure their details are correct and complete (in particular building number and/or intercom number). Failure to comply with the procedures described above and below will result in no claim from the buyer being accepted. Delivery of items is carried out by Chrono Diali services. The buyer is delivered by our courier or a postal agent. In the event of absence or a mailbox that is too small, the buyer or recipient of the ordered product receives a delivery notice from their mail carrier, allowing them to collect the ordered products from the nearest post office within fifteen days. After this period, the parcel is returned to Vaporglobal Logistics. No dispute regarding the delivery itself is possible if the parcel appears to have been delivered, the Chrono Diali system being authoritative. Goods travel at the risk of the recipient, who is responsible for checking for damage and/or missing items upon delivery. In the presence of an apparent anomaly on the parcel (in particular a damaged parcel, an opened parcel, traces of liquid, etc.), the buyer or recipient of the ordered products must not open the parcel but is invited to establish a "report of spoliation" with the mail carrier or at their Post Office when the parcel is handed over. Opening said parcel excludes any recourse with Chrono Diali. Any delivery for which reservations have not been confirmed by registered letter with acknowledgment of receipt within 3 days of its receipt from the carrier, a copy of which will be sent simultaneously to our company, will be considered accepted by the customer. The buyer must also report these incidents to the seller within 48 hours at contact@levapoteurmarocain.com, specifying the order number. Delivery times depend in particular on carrier availability and the order in which orders arrive. Our carrier endeavors to comply with the delivery times it indicates when the order is accepted and to fulfill orders, except in the event of force majeure, or circumstances beyond its control, such as strikes, frost, fire, storm, flood, epidemic, supply difficulties, this list not being exhaustive. Delivery delays cannot give rise to any penalty or compensation. Delivery fees are automatically calculated in the purchase summary and appear in the total amount to be paid. When the buyer orders several products at the same time and these have different shipping times, the order's shipping time is based on the longest delay. The seller however reserves the possibility of splitting shipments.
Article 9: Shipping fees
Shipping fees include a contribution to preparation and packaging costs, as well as postage costs. Should the buyer wish to order several items, it is preferable to group them into a single order in order to only pay shipping fees once. Shipping fees remain the buyer's responsibility.
Article 10: Warranty
The buyer benefits from the legal warranty against hidden defects and non-conformity defects. Only products demonstrating a proven hidden defect may be returned on this basis. In accordance with this article, the customer who claims that their product suffers from a hidden defect must provide proof of this. If the expert assessment confirms the existence of a hidden defect, the supporting document must be sent to Vaporglobal Logistics' customer service as soon as possible. Upon receipt of the document, a written confirmation as well as the procedure to follow and the return address for sending back the product will be communicated by the seller's customer service. Return costs for the product are the customer's responsibility. The return will be accepted after the hidden defect has been verified by the seller's services. Once the return is accepted, the product will be exchanged.
Article 11: Proof of transactions paid by bank card
Data recorded by the CMI on the online payment platform on behalf of Vaporglobal Logistics constitutes proof of the commercial transactions made between you and Vaporglobal Logistics.
Article 12: Right of withdrawal
From the delivery date of their order, the customer has a period of 7 days to exercise their right of withdrawal and be fully refunded. Return shipping costs for the goods remain the customer's responsibility. However, only goods returned in perfect resalable condition, complete, and in their original (unopened) packaging can be refunded.
Article 13: Liability
The seller cannot be held liable for non-performance of the contract in the event of stock shortage or product unavailability due to a case of force majeure, total or partial disruption or strike affecting in particular postal services and means of transport and/or communications, flood or fire that could prevent delivery of the order or cause its destruction. All products marketed by the seller are intended for vapor inhalation production. As no scientific study has been conducted on the potential side effects related to the absorption of certain substances (do not drink the e-liquid), the buyer acknowledges using these products in accordance with the conditions of use and under their full and entire responsibility. The seller therefore cannot be held liable for any sanitary or health problem of any of its customers, or in the event of incidents and any special damages resulting from the use of the products. The seller's liability cannot be engaged in the event of failure to properly use the products in accordance with their intended purpose (or in the event of use of other products), in particular in accordance with the instruction manual and the characteristics provided on the products' presentation pages on the website. Photographs and information contained on the website, illustrating the products presented, are not contractual. Although the seller considers them reliable, the seller's liability cannot be engaged in the event of a photography or text error. In the event of purchases for professional purposes, the seller shall incur no liability for any indirect damages arising from these terms, loss of business, loss of profit, loss of opportunity, damages or costs, which could arise from the purchase of the products. The seller, in the online sales process, is only bound by a best-efforts obligation; its liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, virus, service interruption, or other unintentional problems.
Article 14: Loyalty program
This program allows customers to earn loyalty points, converted into a discount on future orders placed on the site www.levapoteurmarocain.com or in our stores. The program is open to any customer with an active customer account. Enrollment in the program is free and without commitment. Earning points: • The customer earns 1 point for every 10 DH of the amount actually paid for an order, equivalent to 10% of the amount paid in discount value (shipping fees included, after deduction of discounts, promotional codes and points used). • Points are credited once payment of the order is confirmed, online or in store, on a single shared balance. • Tiers increase the points earned: Silver tier (from 300 accumulated points): +20% points; Gold tier (from 800 accumulated points): +50% points. The tier is calculated on all points ever earned and never goes down, even after points are used. Using points: • 1 point equals a 1 DH discount on a future order, online or in store. • Points can be used from 50 points, up to the amount of the order. • Accumulated points have no expiry date. Cancellation or dispute: • If an order is unpaid, refused on delivery or refunded, the associated points are automatically cancelled. • In case of fraudulent or abusive behavior, Le Vapoteur Marocain reserves the right to block or cancel the points concerned without notice and to exclude the member from the loyalty program. Referral: A referral scheme may be offered at a later date. Its conditions will then be published on the site when it is launched. Changes to or termination of the program: Le Vapoteur Marocain reserves the right to modify, suspend or end the loyalty program at any time, without notice or compensation, for any reason. Acceptance of the conditions: Participation in the loyalty program implies full acceptance of these conditions. They can be consulted at any time on the site www.levapoteurmarocain.com.
Article 15: Protection of personal data
The seller undertakes not to disclose to third parties the information you provide. This information remains confidential. It will only be used by our internal departments to process your order, and for communication purposes. The seller reserves the right to place cookies on your computer during visits to the site levapoteurmarocain.com. A cookie does not allow us to identify you but is intended to signal your previous visit to the site in order to help us personalize the service offered to you.
Article 16: Governing law and competent jurisdiction
This contract is entered into in the French language and is governed by Moroccan law. Any dispute that may arise from these terms of sale shall fall within the jurisdiction of the Court of First Instance.
